Please recommend a notary for the writing of a will

Post by hamski »

HI everyone,

I'm looking for a good, reasonably-priced notary for the writing of a will.
Specifically, the notary will need to be well up on Cyprus -- UK domicile rules
pertaining to inheritance tax.

Grateful for any recommendations.
Thank you in advance.

hamski, If you have a UK will then you can copy from that for a will about your property in Cyprus.
The important part is a paragraph at the end stating "I wish this "Will" to be dealt with according to the laws of the UK"
You can then go along to the Pathos courthouse to have your "Will" noted and kept by the court in their record stores.
We redid ours this last May and the cost was approx 56 Euros. You go to a small office in the lobby to obtain these stamps then you go to another office and the Clerk there will do all the necessary. We originally had our wills done by a Cypriot Lawyer at a cost of CY£250 each and sometime later we were informed that, that "will" would be included with our UK Will and therefore subject to Cypriot law which is approx 12% of our whole estate including the UK part. Hope this helps

Thank you, Mike. FYI, I have no property; I'm a minimalist.

I think your detailed information will be useful to lots of people
who read this forum, and to those joining it in future.

Marion Carter is UKI solicitor and is licensed in Cyprus. If you want will written correctly, don't scrimp on getting then prepared professionally. If you hold assets in more then one jurisdiction, you should have a will for each jurisdiction. Don't forget Isle of Man, Jersey, Guernsey are NOT UK.

Just a mention that the Brussels IV law does not apply to those who are domiciled in Cyprus. If you have cut ties with the UK but then opt for UK law of succession to be applied to your will then this will be one of the factors taken into account by HMRC when deciding your domicile for tax purposes. If your domicile is determined to be UK, you cannot take advantage of the Cyprus zero inheritance tax. The hefty UK inheritance tax of 40%, if you are above the threshold, would then be applied to your estate.

Hamski, as has been said Cyprus is not the UK and has different laws regarding inheritance and inheritance tax and probate here is a long, drawn out procedure. It’s very sensible to get a good Cyprus solicitor to advise according to your own circumstances when drawing up your will. It could save your family/ spouse a lot of problems in the future.

We just used Zambartas lawyers to update our Cyprus wills, our estate will now be dealt with by Scottish law.

We recommend Louise Zambartis. She is on the BHC List of lawyers and did a fantastic job of getting us our title deeds, whilst others in exactly the same position as us are still waiting. Our English and Cyprus wills have been drawn up by her, and the vital clause that we want English Law to take precedence has been inserted.

Thanks for the recommendations, Jamboal and John.
Previous posters recommended Marion Carter. I mailed her a while back,
but no answer, so I'm pleased to have another recommendation to go on.
Thank you very much.

Most of us change our service providers at one time or another - not atypical!
BTW, her website is at http://www.solicitors-cyprus.com
And HIC's first telephone number is the one quoted on the website.
There is also another email address you can try info@solicitors-cyprus.com
